Guardian Medical Direction, Inc. (“Guardian Medical Direction”) respects your intellectual property rights and we take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. This Copyright & DMCA Policy outlines how you can submit a notice of copyright infringement and the procedures for countering such notices.

How to Report a Claim of Copyright Infringement

If you believe any materials accessible on or from the www.guardianmedicaldirection.com website (the “Site”) infringes your copyright, you may request removal of those materials (or access to them) from the Site by submitting written notification to our copyright agent designated below. In accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”), you must provide written notice (the “DMCA Notice”) including the following information:

  • Your physical or electronic signature (including your typed name) as the copyright owner or person authorized to act on their behalf.

Guardian Medical Direction’s response to a DMCA Notice, may include, in its sole discretion, removing or restricting access to allegedly infringing material. Please note that information provided in a DMCA Notice may be forwarded to the user who posted the allegedly infringing content.

How to Submit a Counter Notice

If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter notification with us (a “Counter Notice”) by submitting written notification to our copyright agent designated below.

Pursuant to the DMCA, the Counter Notice must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  • A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled because of a mistake or misidentification of the material to be removed or disabled.
  • A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Site may be found) and that you will accept service from the person (or an agent of that person) who provided the Site with the complaint at issue.
  • Your contact information, including your name, address, phone number and email address.
  • Your physical or electronic signature (including your typed name).

If you fail to comply with all the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice or Counter Notice may not be effective.

Restoration of Removed Content

Guardian Medical Direction will forward a valid Counter Notice to the party who submitted the original DMCA Notice. The notifying party will then have ten (10) business days to file a court action against you relating to the allegedly infringing material. If we do not receive any notification of such court action from the notifying party within ten business days, the DMCA allows us to restore the removed content.

Bad Faith Notices and Counter Notices

Please be aware that if you knowingly materially misrepresent that material or activity on the Site is infringing your copyright, or if you knowingly materially misrepresent that material or activity on the Site was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

Repeat Infringers

  • Deletion of Your Personal Information. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

We will delete or de-identify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Limiting the Use of Sensitive Personal Information

California residents have the right to limit the use of sensitive personal information. Guardian Medical Direction only collects sensitive personal information, such as your social security number, financial account information, and as otherwise defined by applicable law, when you provide it to us, such as in the job application process. We only use such sensitive personal information for the use disclosed at the time you provide it to us. Guardian Medical Direction does not use sensitive personal information for inferring characteristics about you.

Opting Out of Cookies and Sale/Sharing Using Online Tracking Technologies

Our use of online tracking technologies may be considered a sale or sharing under applicable law. As a visitor to our Site, you can opt out of being tracked by these third parties by clicking the “Do Not Sell My Personal Information” link at the bottom of our Site and selecting your preferences. If you are a visitor or patient of any of our customers (Provider Wesbite Visitor) and would like to make any requests or queries regarding your personal information, please contact your healthcare provider directly. For example, if you wish to request to access, correct, update, or delete inaccurate personal information processed by Guardian Medical Direction on behalf of our customers, please direct your query to the relevant Guardian Medical Direction customer who controls such data. If Guardian Medical Direction is requested by our customers to remove any Provider Website Visitor personal information, we will respond to such requests in a timely manner upon verification and in accordance with applicable law.

Exercising Your Rights

You can submit a request to access, update, correct, or delete your personal information, or withdraw consent, by submitting a request through our contact form or by calling (877) 340-1697.

You may only submit a request to know twice within a 12-month period. Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include your first and last name and email address.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Identity Verification

For security purposes, we may request additional information from you to verify your identity to enable us to process some requests. In such cases, we may contact you by email to verify your request. Depending on your request, we will ask for information such as your name and the email address associated with your Guardian Medical Direction account.

Authorized Agent

If you are a resident of California, Colorado, or Connecticut, you may designate an authorized agent to submit a request on your behalf to exercise your privacy rights described herein. To authorize an agent to do so, you must: (1) provide to such agent your signed permission to submit such request; and (2) verify your own identity directly with us. We may deny a request from an authorized agent if the agent does not provide adequate proof that they have been authorized by you to act on your behalf.

Upon receipt of your request, we will respond within the time frame permitted by the applicable law.

Appealing Requests

If you are a Colorado, Connecticut, or Virginia resident, you may appeal our decision to your request regarding your personal information. Children’s Privacy

Our Platform is not intended for or directed to children under the age of 18. We do not knowingly collect personal information directly from children under the age of 18 without parental consent. Children under 18 are not permitted to use the Platform and we do not knowingly allow individuals under the age of 18 to create accounts that allow access to our Platform. If we become aware that a child under the age of 18 has provided us with personal information, we will delete the information from our records.

Without limiting the above, the Platform does allow individuals over the age of 18 years—such as you, parents and guardians—to provide, share, and store personal information about others, including minors and children. Any user providing, storing, or submitting information on behalf of a child assumes full responsibility over the submission, use and transmission of such information.

We do not knowingly “sell,” as that term is defined under the California Consumer Privacy Act, the personal information of minors under 16 years old who are California residents.
